Today, we tackle a difficult subject – criminal records, particularly driving under the influence of alcohol and/or drugs (DUI). During or after the visa interview, some visa applicants may be asked to submit additional documents. These documents may vary based on applicants¡¯ circumstances. Among them may be criminal records, court records, and/or medical reports.


If an applicant has record of DUI, or other arrests or criminal activity, the adjudicating officer may ask the applicant to submit (1) an unexpunged Criminal and Investigation History Report issued by the Korean National Police, and (2) court records regarding the criminal incident, along with the English translation.

If you have had any legal incidents in any country, including an arrest or conviction, you must report this on your DS-160 application. This includes any alcohol-related incidents such as DUIs. Failure to report arrests or convictions on your application may result in a finding making you ineligible for a visa to the United States. Even if another party filled out the DS-160 on your behalf, and failed to make such disclosures, you are ultimately responsible for your application.

If you have had any DUI convictions within the last five years or two or more within the last ten years, or if there is reason to believe that you may have an alcohol-related problem, you must undergo a medical exam evaluation. The consular officer will further explain this process during your interview.
